Osek patur, osek zair or osek murshe: which self-employed status to choose in Israel in 2026
First invoice in Israel? Before you issue it, you need a VAT status and, since 2024, an income-tax regime. The right choice comes down to three numbers: your turnover, your real expenses and who your clients are.
The short answer
A self-employed person in Israel has a VAT status and an income-tax regime. VAT: osek patur if turnover stays under ₪122,833 a year in 2026 (no VAT charged, none reclaimed), osek murshe above that or by choice (18% VAT charged and reclaimed). Income tax, since 2024: the osek zair regime, open under the same ceiling, deducts 30% of turnover as flat expenses, no receipts needed, with a simplified return. Profit is then taxed on the income-tax brackets, plus self-employed Bituach Leumi contributions (7.70% then 18%). Three files to open before the first invoice: VAT, income tax, Bituach Leumi.

The three statuses, and why people mix them up
The confusion comes from two different authorities classifying the same person: VAT (ma'am) decides whether you charge the tax, income tax (mas hachnasa) decides how your profit is computed. So a freelancer is, at the same time, patur or murshe for VAT, and zair or on the actual-expenses regime for income tax.
| Osek patur | Osek murshe | Osek zair regime | |
|---|---|---|---|
| What it is | VAT status | VAT status | Income-tax regime (since 2024) |
| Condition | Turnover ≤ ₪122,833/year; some professions excluded | Above the ceiling, by choice, or an excluded profession | Turnover ≤ ₪122,833/year, no employees, income from personal work |
| VAT on sales | None (simple receipt) | 18%, tax invoice | Per VAT status |
| VAT on purchases | Not reclaimable | Reclaimable | Per VAT status |
| Expenses | Actual, documented | Actual, documented | 30% flat, no receipts |
| Annual return | Full | Full + periodic VAT returns | Simplified, by 31 March |
| VAT return | Once a year (turnover) | Monthly or bimonthly | Per VAT status |
| Bookkeeping | Income ledger | Income and expense ledgers, VAT documents | Income only |
Regulated professions (lawyers, doctors, accountants, architects, consultants and others) cannot be osek patur: they are murshe from the first shekel. The list is set by regulation; when in doubt, it is the first question for your accountant.
Which one to choose: three questions
- Do your clients reclaim VAT? Israeli businesses do: for them a murshe invoice at 118 costs 100, and a patur receipt at 100 costs 100. As a murshe you can therefore charge 18% more at no cost to them, and reclaim your own VAT. Private individuals and foreign clients do not: patur keeps the price advantage.
- Are your real expenses above 30% of turnover? If not (consultant, writer, coach, solo developer), the osek zair regime saves tax and paperwork. If so (equipment, subcontractors, premises, vehicle), the actual-expenses regime wins.
- Will you pass ₪122,833? If it is likely within the year, start as murshe: switching mid-year costs non-billable VAT on the excess and two sets of books.
| Actual expenses | Osek zair regime | |
|---|---|---|
| Turnover | ₪100,000 | ₪100,000 |
| Expenses deducted | ₪12,000 | ₪30,000 (30%) |
| Taxable profit | ₪88,000 | ₪70,000 |
| Tax difference (14–20% brackets) | roughly ₪2,500 to ₪3,600 a year in favour of osek zair, before credit points | |
Registering: the three counters
- VAT (ma'am): form 821 at your regional VAT office or online with a digital ID. You get your osek number (your teudat zehut number for an individual) and patur or murshe status. Documents: teudat zehut, lease or proof of address, sometimes a bank statement. This registration gates the other two.
- Income tax (mas hachnasa): form 5329, online or at the assessing office. The Tax Authority sets your advance rate (mikdamot) and tells you whether you must withhold tax from your suppliers.
- Bituach Leumi: form 6101 (self-employed declaration) online. You declare an estimated income; advances are computed on it, then settled against your tax return. Minimum ₪265 a month in 2026, even with no income.
- Dedicated bank account and, for a murshe, approved invoicing software (tax invoices need an allocation number above a certain amount). The main Israeli packages handle both patur and murshe.
- Osek zair regime: osek patur are enrolled automatically and notified; others request it from the assessing officer before the return deadline. Opting out is possible.
An accountant handles the three registrations in a few days for a modest flat fee, often included in the first year's retainer. Doing it yourself is feasible for a simple osek patur; beyond that, the hours quickly outweigh the fees saved.
Tax, advances and contributions
Self-employed profit is taxed on the income-tax brackets after credit points, like a salary: the same 2.25 base points, points for children, oleh points. Three mechanisms are specific to the self-employed:
- Tax advances (mikdamot), a percentage of turnover paid monthly or bimonthly, settled with the annual return. Too high a rate ties up cash; it can be revised on a reasoned request.
- Self-employed Bituach Leumi contributions: 7.70% of income up to ₪7,703 a month (4.47% national insurance + 3.23% health), 18% above (12.83% + 5.17%), up to the ₪51,910 ceiling. In return, 52% of national-insurance contributions are deductible from taxable income. Details and the benefits they open in the Bituach Leumi guide.
- Withholding by your clients (nikui mas bamakor): without an exemption or reduced-rate certificate, a business client withholds up to 30% of your fees. The certificate is obtained online as soon as your file is open; ask for it first.
| Monthly profit | Income tax | Bituach Leumi + health | Total deductions |
|---|---|---|---|
| ₪6,000 | ~ ₪56 | ~ ₪462 | ~ 8.6% |
| ₪10,000 | ~ ₪584 | ~ ₪1,007 | ~ 15.9% |
| ₪20,000 | ~ ₪2,902 | ~ ₪2,807 | ~ 28.5% |

Deductible expenses (actual-expenses regime)
Deductible means incurred to produce the income, with a receipt in your name. In practice:
| Deductible | Partly | Not deductible |
|---|---|---|
| Equipment, software, professional subscriptions | Phone, internet, home electricity (share) | Daily meals, clothing |
| Office rent, coworking | Share of home rent (dedicated office) | Commuting |
| Accountant, lawyer, professional insurance | Vehicle (specific rules and caps) | Fines, gifts above the cap |
| Training tied to the business, advertising, website | Entertainment (capped) | Mixed personal spending without receipts |
| Pension and keren hishtalmut (within caps), 52% of Bituach Leumi | Trips abroad (business purpose, daily caps) | The tax itself |
Two deductions freelancers forget: pension savings, mandatory for the self-employed since 2017 and deductible up to a cap, and the self-employed keren hishtalmut, whose contributions are deductible and whose gains are tax-free after six years. They are the two most effective and simplest optimisation levers.
Invoices, receipts and bookkeeping
- Osek patur: you issue numbered receipts (kabala), no VAT, marked "osek patur". You keep an income ledger and the supporting documents. One turnover declaration to VAT per year (in January); annual tax return, simplified under osek zair.
- Osek murshe: you issue tax invoices (cheshbonit mas) with VAT, then a receipt on payment, or a combined invoice-receipt. Monthly VAT return (bimonthly under a turnover threshold), paying VAT collected minus VAT deductible. Above a per-invoice amount lowered each year, the invoice must carry an allocation number from the Tax Authority (e-invoicing).
- Software: approved Israeli invoicing software (Green Invoice/Morning, iCount, Hashavshevet and others) handles numbering, VAT, withholding and exports for your accountant. Word or Excel invoices are not compliant for a murshe.
Switching to osek murshe: when and how
The switch is mandatory as soon as the year's turnover passes ₪122,833: VAT is due on the excess, and since your clients already paid without VAT, it comes out of your pocket (18% of the excess). It is better to switch beforehand, as soon as the trajectory is clear, by request to the VAT office; Bituach Leumi must be told so advances are adjusted. The switch is chosen by those whose clients are Israeli businesses (VAT neutral for them, reclaimable for you) or who invest in equipment (VAT reclaimed on the purchase). Going back from murshe to patur is possible after two years under the ceiling, on request.
Clients abroad, remote work
Many freelancers in Israel bill clients in the US, the UK, France or elsewhere. Three rules:
- VAT: a service supplied to a foreign client is in principle zero-rated; an osek murshe bills it without VAT and still reclaims VAT on purchases, which makes murshe attractive for exporters. Exceptions: the client has activity in Israel, or the service relates to an asset located in Israel.
- Income tax: income from work performed in Israel is Israeli-source, taxable in Israel from day one, even for an oleh exempt on foreign income; the point is detailed in the oleh benefits guide. For US citizens, the income remains reportable in the US, with the foreign earned income exclusion or foreign tax credit under the US–Israel treaty, and self-employment tax questions that depend on the totalization agreement.
- Getting paid: clients pay in dollars, pounds or euros; conversion costs 1 to 3% at an Israeli bank. The transfer comparison shows the channels that bring that cost close to zero, and a multi-currency account avoids converting at the wrong moment.
Six common mistakes
- Invoicing before the VAT file is open. Receipts issued without an osek number are not valid, and the delay is regularised with penalties.
- Staying patur past the ceiling: 18% VAT on the excess, not billable to clients.
- Not requesting the withholding certificate and letting clients hold back 30% of fees for months.
- Forgetting Bituach Leumi: the file opens separately, and the omission costs arrears with interest, plus cover (work injury, maternity) that did not exist.
- Staying on actual expenses with few expenses when osek zair would save several thousand shekels and simplify the return.
- Neglecting pension and keren hishtalmut, the two most profitable self-employed deductions, the first being mandatory.
Frequently asked questions
What is the osek patur ceiling in 2026?
₪122,833 of annual turnover (₪120,000 in 2025). The ceiling is indexed every 1 January. Above it, you owe 18% VAT on the excess, which you cannot bill to clients retroactively, and your status switches to osek murshe.
Osek patur, osek zair, osek murshe: what is the difference?
Osek patur and osek murshe are VAT statuses: the first charges no VAT (turnover under the ceiling), the second charges 18% and reclaims VAT on purchases. Osek zair is an income-tax regime introduced in 2024, open to either VAT status under the same ceiling: 30% of turnover is deducted as a flat expense allowance, with no receipts, and the annual return is simplified.
Do I need to register before my first invoice?
Yes. Three registrations, in this order: VAT (ma’am, form 821, which assigns patur or murshe status), income tax (mas hachnasa, form 5329) and Bituach Leumi (form 6101). An accountant does all three within a week; online, VAT registration runs through the Tax Authority site with a digital ID.
Can an osek patur work for clients abroad?
Yes, and it is often advantageous: exported services are billed without VAT whatever your status, and for an osek murshe they still allow VAT on purchases to be reclaimed. The export exemption has exceptions (a client with activity in Israel, services tied to an asset in Israel): check with your accountant.
How much tax does a self-employed person pay?
Profit (income minus expenses, or income minus 30% under osek zair) is taxed on the income-tax brackets after credit points, exactly like a salary. Add Bituach Leumi contributions for the self-employed: 7.70% up to ₪7,703 a month, 18% above. The income-tax guide and the calculator give the figure.
What are mikdamot?
Tax advances. The Tax Authority sets a percentage of turnover to pay monthly or bimonthly (online, on the Tax Authority site), settled with the annual return. In year one the rate is an estimate; you can ask for a reduction if the business starts slowly.
Which expenses are deductible?
Those incurred to earn the income: equipment, software, phone and internet (pro rata), office rent or a share of your home, business travel, training, accountant fees, pension and keren hishtalmut contributions within the caps, and 52% of national insurance contributions. Daily meals, clothing and commuting are not. A car is deducted under specific, capped rules.
Do I need a separate bank account?
Recommended for an osek patur, required in practice for an osek murshe (the bank asks for it). A dedicated account simplifies bookkeeping and audits. The banks guide compares business accounts.
Can I be an employee and an osek patur at the same time?
Yes, it is very common. Income is pooled in the same brackets; request a tax coordination (teum mas) so that your employer and your advances do not double up. Bituach Leumi is calculated on the total, with priority rules between salary and self-employed income.
What changes in 2027?
The osek patur ceiling and the osek zair threshold are indexed in January 2027. The gradual move to e-invoicing (a mandatory allocation number for invoices above a threshold lowered each year) mainly affects osek murshe. This page is updated with every official publication.
